Terms of service

These Terms of Service (the "Terms") govern your access to and use of the website, online store, and services (collectively, the "Services") operated by Bizanci Europe SL, trading as Moryarty Vintage Posters ("Moryarty", "we", "us", or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

To make a purchase on Moryarty, you must be at least 18 years old and capable of entering into a legally binding contract under Spanish law. By placing an order, you confirm that you meet these requirements.

2. Products

Moryarty sells art posters and prints. We make every reasonable effort to display the colours and details of each item accurately, but slight variations may occur due to screen settings, lighting, paper type, and the printing process.

We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, stock unavailability, or suspected fraud.

3. Prices and payment

All prices are displayed in the local currency of the storefront you are using, and include VAT where applicable under EU law. Shipping costs are calculated separately at checkout.

We accept payment via the methods displayed at checkout (credit/debit card, and any other methods enabled at the time). Payment is processed by Shopify Payments and other third-party processors; Moryarty does not store full payment card data.

In the event of an obvious pricing error, we reserve the right to cancel the order and refund any payment received.

4. Order confirmation and contract formation

After placing an order, you will receive an automatic order confirmation by email. This confirmation acknowledges receipt of your order but does not constitute acceptance. The contract of sale is formed only when we dispatch the item and send you a shipping confirmation.

5. Right of withdrawal

If you are a consumer resident in the European Union, you have the right to withdraw from the contract within 14 calendar days of receiving the item, in accordance with Real Decreto Legislativo 1/2007. See our Return and Refund Policy for the procedure.

6. Legal warranty

All sales to consumers are covered by the legal warranty of conformity under Real Decreto Legislativo 1/2007, which provides a 3-year warranty from delivery for movable goods sold to consumers in the EU.

7. Intellectual property

All content on the Services — including text, images, photographs, logos, and design — is the property of Bizanci Europe SL or its licensors and is protected by intellectual property law. You may not copy, reproduce, distribute, or use this content commercially without our prior written consent.

The purchase of a poster grants you ownership of the physical print only; it does not transfer any underlying copyright or reproduction rights.

8. User accounts

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.

9. Acceptable use

You agree not to use the Services for any unlawful purpose, to interfere with their operation, to attempt to gain unauthorised access, or to use automated tools (bots, scrapers) without our prior written consent.

10. Limitation of liability

To the maximum extent permitted by law, our liability arising from the Services and any product sold is limited to the price paid for the relevant order. Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection law.

11. Force majeure

We are not liable for delays or failures in performance caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, carrier failures, governmental actions, or interruptions to internet and telecommunications.

12. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Services after changes constitutes acceptance of the revised Terms.

13. Governing law and jurisdiction

These Terms are governed by the laws of Spain. Any dispute arising from these Terms or the Services shall be submitted to the competent courts of Barcelona, Spain, without prejudice to any mandatory consumer protection rights granting you access to the courts of your country of residence.

14. Online dispute resolution

In accordance with EU Regulation 524/2013, consumers in the EU may also access the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.
